Editorial: Resign, Councilmembers Nury Martinez, Kevin de León and Gil Cedillo are wrong for not resigning.
The resignation letter reads:
“As you are aware, with the recent changes to our city code, the District Council president (Kevin de León) and the three members of the council (Gil Cedillo, Nury Martinez, and me) are no longer allowed to serve on the Budget and Legislative Review Commission. As the citizens of San Miguel have the right to expect no less, it is now up to the City to make good on this request to have the resignations withdrawn. This is of great importance to us and the voters, and we should not have to take this action.”
The resignation letter does not include any details of the “changes to our city code,” nor does it contain a suggestion of the “consequences of the vote of the citizens for the city of San Miguel.”
This resignation letter is riddled with falsehoods and a lack of knowledge of the truth.
Our city code does not prohibit our elected officials from serving on the Budget and Legislative Review Commission. It states in Section 9.03:
“The District Council President and the Mayor shall be members of the Budget and Legislative Review Commission.”
This has been the position of our elected officials since our city charter was adopted. It is the position of the people of San Miguel.
The resignation letter states that the three councilmembers and the city council president have been “no longer allowed to serve on the Budget and Legislative Review Commission,” but the resignation letter does not state what the city council president and the three councilmembers have been “no longer allowed to serve on the Budget and Legislative Review Commission,” just that they have been “no longer allowed.”
The city council president and three councilmembers are members of the Commission, and the city council president and the three councilmembers are serving on the Commission.
